This is a precedent s189 Retrenchment Notice and provides for dismissal of employees by way of retrenchment, on the basis of financial, technical or operational reasons.

The notice has been drafted in accordance with the Labour Law of South Africa as is regulated by the Basic Conditions of Employment Act, 1997 (“the BCEA”) and the Labour Relations Act, 1995 (“LRA”).

The Retrenchment Notice includes a consultation process, sets out the reasons for the dismissal (retrenchment) and provides for the alternatives and the process going forward.

Dismissal on the basis of Operational requirements

In South Africa, our Labour Law is regulated by the Basic Conditions of Employment Act, 1997 (“the BCEA”) and the Labour Relations Act, 1995 (“LRA”).

In terms of the LRA, a dismissal of an employee must be substantively and procedurally fair. One of the substantive reasons is a dismissal on the grounds of operational requirements.
